4. User Conduct & Prohibited Use

You agree to use the Services only for lawful purposes. You are strictly prohibited from:

  • Reverse Engineering: Attempting to decompile, reverse engineer, or copy our AI models or source code.

  • Harmful Content: Using the Services to generate hate speech, deepfakes, malware, sexually explicit content, or content that promotes violence or illegal acts.

  • Interference: Disrupting the security, integrity, or performance of our website or servers.

  • Data Scraping: Collecting data from our website using automated bots or scrapers without permission.

5. Intellectual Property

  • Our IP: All content, logos, algorithms, software, and branding associated with Bizwit AI are the exclusive property of Bizwit AI and its licensors.

  • Your Data: You retain ownership of the data you input into our system. However, by using the Services, you grant us a worldwide, non-exclusive license to process your inputs to provide the Services and improve our AI models (subject to our Privacy Policy).

7. Disclaimers & Limitation of Liability

A. For Users in the United States & General Global Users

TO THE FULLEST EXTENT PERMITTED BY LAW:

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." BIZWIT AI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

BIZWIT AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS OR $100 USD, WHICHEVER IS GREATER.

B. For Users in Australia (Australian Consumer Law)

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that under the Competition and Consumer Act 2010 (Cth) cannot be excluded ("Non-Excludable Guarantees"). If a Non-Excludable Guarantee applies, our liability is limited to the resupply of the services or the cost of having the services supplied again.

C. For Users in the UK & Europe

Nothing in these Terms excludes our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

You agree to indemnify, defend, and hold harmless Bizwit AI, its owner Priyank Singh, and its affiliates from any claims, liabilities, damages, and expenses (including legal fees) arising out of your violation of these Terms or your misuse of the AI Services.

Our website may contain links to third-party websites or services (e.g., Google, Meta). We are not responsible for the content, privacy policies, or practices of any third-party sites.

10. Termination

We reserve the right to suspend or terminate your access to our Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

11. Governing Law & Dispute Resolution

  • Jurisdiction: These Terms shall be governed by the laws of India.

  • Dispute Resolution: Any dispute arising out of these Terms shall first be attempted to be resolved through amicable negotiation. If unresolved within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the courts in India.

  • Exceptions: If you are a consumer in the EU, UK, or Dubai, you may benefit from mandatory provisions of the law of the country in which you are resident, and nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
